Personal Information We Collect

We do not collect sensitive information, as defined under applicable law.

You may opt-in to receive SMS notifications from us in order to receive order updates and marketing information from us. SMS notifications will only be sent to you to fulfill the purpose for which you have shared your phone number with us. We only share your phone number with third party services like Attentive, who help us send SMS notifications to you. You may opt-in to our SMS delivery services by entering your phone number when prompted at check-out, or by sending a message to the phone number specified on the SMS Policy included in our website.

You may choose to receive SMS/text information from us through your mobile device. You may unsubscribe at any time by replying STOP. By opting into our SMS service, you consent to receive mobile text alerts using automatic telephone dialing systems. Standard messaging and data may apply depending on your mobile carrier and plan. Consent to receive marketing text messages is not required as a condition of purchasing any goods or services. We are not liable for delayed or undelivered messages. After opting out you will no longer receive SMS messages, unless you opt back in. You may receive additional messages after opting out to confirm you have unsubscribed.

Do Not Track

We do not alter our website's data collection and use practices when we detect a Do Not Track signal from your browser.

Your Data Privacy Rights

Residents of Texas have the right to:

  • Right to Know

You can request information about how we have collected, used, and shared your personal information during the past 12 months. 

  • Right to Access

You can request a copy of the Personal Information that we maintain about you. 

  • Right to Delete

You may request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request. We may deny your deletion request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies. 

  • Right to Correct

You may also request that we correct any of your personal data that has become outdated or needs correction for any reason. 

Exercising Your Rights

To access or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. As permitted by applicable law, any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”). We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the consumer about whom we collected personal information.

Only you, or someone legally authorized to act on your behalf (an “Authorized Agent”), may make a request to know or delete related to your personal data. We require Authorized Agents to provide written authorization confirming they may submit a request on your behalf. You may only submit a request to know twice within a 12-month period. We endeavor to substantively respond to a Verifiable Consumer Request within forty-five (45) days of its receipt unless we require an extension. If we reasonably require an extension, we will inform you of the reason and extension period.

Once we receive your request and confirm your identity, we will review your request. We may deny your deletion request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies. 

In the event your data request is denied, Texas residents may also appeal that denial. In the event we deny your data rights request, you may appeal our decision by emailing us or calling us at the information provided above. You will receive confirmation of the action being taken regarding your appeal within 60 days of receipt of your appeal.

Non-Discrimination

We will not discriminate against you for exercising any of your data subject rights. We do not charge a fee to process or respond to your Verifiable Consumer Request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Notice to European Residents

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise these rights, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.
